Terms and Conditions

1. Introduction

These Terms and Conditions govern your use of the Louise Driver Tuition Resource Platform ("the Platform"), including access to videos, downloadable resources, PDF documents and other educational materials provided by Louise Driver Tuition ("we", "us", "our"), which is the trading name of Louise Feather ADI.

By creating an account, purchasing resources, subscribing to the Platform or accessing any content made available through the Platform, you agree to be bound by these Terms and Conditions.

If you do not agree with these Terms and Conditions, you must not use the Platform.

2. Eligibility

The Platform is intended for driving instructors, trainee driving instructors (PDIs), instructor trainers and other individuals involved in driver education.

You must be at least 18 years of age to create an account and use the Platform.

3. Subscription Service

The Platform offers a monthly subscription service. The current subscription fee is £40 per month unless otherwise stated.

An active subscription provides view-only access to all resources available on the Platform, including videos, PDF documents and other educational materials.

Subscription access does not grant ownership of any resources.

Unless expressly stated otherwise, resources accessed through a subscription may not be downloaded, printed, copied, distributed or shared.

Access to subscription-only resources remains available only while the subscription is active and paid in full.

We reserve the right to add, remove, update or replace resources available through the subscription service at any time.

4. Individual Resource Purchases

Certain resources may be available for separate purchase.

When a resource is purchased, the purchaser is granted a personal, non-exclusive and non-transferable licence to:

View the resource;
Download the resource where applicable;
Print the resource for their own professional use.

Purchased resources remain accessible to the purchaser even if their subscription subsequently expires or is cancelled.

The purchase of a resource grants a licence to use that resource; ownership and intellectual property rights remain with Louise Driver Tuition.

5. Updated Versions of Purchased Resources

Where Louise Driver Tuition updates, revises or improves a purchased resource, purchasers will normally receive access to the most recent version of that resource at no additional cost.

Louise Driver Tuition reserves the right to determine whether a revised resource constitutes:

An update to an existing resource; or
A new resource requiring a separate purchase.

6. Business Use of Purchased Resources

Purchased resources may be used by the purchaser within their own driving instruction or instructor training business.

Permitted uses include:

Use with pupils during driving lessons;
Use with trainee driving instructors (PDIs);
Use during one-to-one coaching, mentoring or instructor training sessions;
Printing copies for use with the purchaser's own pupils or trainees;
Providing printed or digital copies of worksheets, handouts and supporting materials directly to the purchaser's own pupils or trainees as part of the purchaser's delivery of training.

Users may not:

Resell, sublicense or distribute resources to other instructors, trainers, businesses or organisations;
Provide copies of resources to other driving instructors, instructor trainers or training organisations;
Share editable source files or master copies of resources;
Upload resources to websites, cloud storage services, social media platforms or shared online systems where they may be accessed by others;
Rebrand, modify or present resources as their own work;
Include resources within paid courses, memberships, subscription services or commercial training programmes without prior written permission from Louise Driver Tuition.

The licence granted to purchasers is personal and may not be transferred to another individual or organisation.

For the avoidance of doubt, a driving instructor who purchases a resource may provide copies of that resource to their own pupils or trainees for educational purposes, but may not distribute the resource to other instructors or businesses.

7. Subscription Cancellation

Subscribers may cancel their subscription at any time through their account settings or by contacting Louise Driver Tuition.

Cancellation prevents future subscription renewals but does not entitle the subscriber to a refund for any unused portion of the current subscription period unless required by law.

Subscription benefits will continue until the end of the current paid subscription period.

When a subscription ends:

Access to subscription-only resources will cease;
Access to individually purchased resources will continue;
Download and print rights for purchased resources will continue;
Access to future updates of purchased resources will continue in accordance with Section 5.

8. User Accounts and Security

Users are responsible for maintaining the confidentiality of their account credentials.

Account details must not be shared with any other person.

Users are responsible for all activity carried out through their account.

If a user believes their account has been compromised, they must notify Louise Driver Tuition as soon as reasonably possible.

9. Acceptable Use

Users agree not to:

Share account access with another person;
Copy, reproduce or redistribute Platform content except as expressly permitted by these Terms;
Circumvent, disable or interfere with security features or access controls;
Upload Platform content to file-sharing services or public websites;
Use the Platform for any unlawful purpose;
Remove copyright notices, watermarks or other identifying information from resources.

Any breach of these Terms may result in suspension or termination of access.

10. Artificial Intelligence and Automated Systems

Users must not upload, submit or otherwise provide any resource obtained through the Platform to artificial intelligence systems, machine learning systems, large language models or similar automated technologies for the purpose of:

Training or improving artificial intelligence systems;
Generating derivative educational materials intended for commercial use;
Creating competing products or services;
Extracting, reproducing or republishing substantial portions of Platform content.

Users may use artificial intelligence tools to assist with their own learning or understanding of resource content, provided such use does not involve redistribution, reproduction or commercial exploitation of Louise Driver Tuition intellectual property.

All intellectual property rights in Platform resources remain vested in Louise Driver Tuition.

11. Content Protection and Watermarking

Louise Driver Tuition may apply digital watermarking, account identification markers or other security measures to downloaded resources.

These measures may include the purchaser's name, account details, transaction reference or other identifying information.

Users must not remove, alter, obscure or attempt to bypass such security measures.

Any unauthorised distribution of watermarked materials may result in suspension or termination of access and may lead to legal action where appropriate.

12. Intellectual Property

All videos, documents, lesson plans, worksheets, diagrams, presentations, graphics, branding and other content made available through the Platform remain the intellectual property of Louise Driver Tuition unless otherwise stated.

No ownership rights are transferred through subscription or purchase.

Users may not reproduce, distribute, publish, sell, licence or otherwise exploit Platform content except as expressly permitted by these Terms and Conditions.

13. Professional Judgement

The resources provided through the Platform are intended to support the professional development of driving instructors, trainee driving instructors and instructor trainers.

Users remain responsible for exercising their own professional judgement and for complying with all applicable laws, regulations, standards and guidance relevant to their work.

Platform resources are educational in nature and should not be regarded as professional, legal or regulatory advice.

Louise Driver Tuition accepts no responsibility for decisions made solely on the basis of Platform resources.

14. Availability of the Platform

Louise Driver Tuition will make reasonable efforts to maintain the availability of the Platform.

However, uninterrupted access cannot be guaranteed.

The Platform may be temporarily unavailable due to:

Maintenance;
Software updates;
Security measures;
Technical faults;
Circumstances beyond our reasonable control.

Louise Driver Tuition shall not be liable for temporary interruptions to service.

15. Pricing and Changes

Louise Driver Tuition reserves the right to change subscription fees, resource prices and payment terms.

Any changes to subscription pricing will be communicated in advance and will apply to future billing periods.

Continued use of the Platform after a pricing change takes effect constitutes acceptance of the revised pricing.

16. Refunds

Subscription payments are generally non-refundable once access has been provided, except where required by applicable law.

Refund requests relating to individually purchased resources will be considered in accordance with applicable consumer protection legislation and any published refund policy.

17. Limitation of Liability

To the fullest extent permitted by law, Louise Driver Tuition shall not be liable for:

Loss of profits;
Loss of business opportunities;
Loss of revenue;
Loss of data;
Indirect or consequential losses arising from use of the Platform.

The total liability of Louise Driver Tuition for any claim arising from use of the Platform shall not exceed the total amount paid by the user during the twelve months preceding the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any liability that cannot legally be excluded under the laws of England and Wales.

18. Suspension and Termination

Louise Driver Tuition reserves the right to suspend or terminate access to the Platform where a user:

Breaches these Terms and Conditions;
Shares content unlawfully;
Shares account credentials;
Engages in fraudulent or abusive conduct;
Infringes intellectual property rights.

Where appropriate, reasonable notice will be provided. Immediate suspension may occur where necessary to protect the Platform, its users or its intellectual property.

19. Changes to These Terms and Conditions

Louise Driver Tuition may amend these Terms and Conditions from time to time.

Updated versions will be published on the Platform and will take effect from the stated effective date.

Continued use of the Platform after changes are published constitutes acceptance of the revised Terms and Conditions.

20. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.

Any dispute arising from or relating to these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
